Let us remind you that the minimum wage is not a new concept in labor legislation. It was introduced back in 1991 in order to protect the rights of the working population. Can a salary be less than the minimum wage?

However, it's not that simple. There are situations when the salary is lower than the minimum wage:

  • A citizen does not work under an employment contract, but under a contract or paid services. In this case, the employer acts as a customer and can pay for the work of the employee (performer), without paying attention to the minimum wage.
  • The employee did not work the entire working time limit during the reporting month. For example, I was on vacation or on sick leave. Or he did not properly fulfill his work obligations. In this case, the monthly salary may be lower than the minimum wage.
  • A salary below the minimum wage may be paid to an employee for a part-time or part-time work week. Indeed, with this option, wages are calculated in proportion to the time worked or the amount of work completed. For example, if a 4-day work week is established for a specific position, then the minimum acceptable wage may be 4/5 of the minimum wage.
  • The citizen works part-time. Then the employer is not obliged to increase the salary to the minimum wage. After all, a part-time worker does not work a full 40-hour work week. His remuneration is calculated only on the basis of hours worked.

Also, do not forget that wages are subject to tax. For residents of the Russian Federation it is 13%. Therefore, it is acceptable if, after deducting personal income tax, the employee receives an amount less than the minimum wage.

The main thing is that “dirty” wages from May 1, 2018 exceed 11,163 rubles.

They pay less than the minimum wage: is it legal?

Let's turn to the labor code, namely Art. 133 Labor Code of the Russian Federation. It states that the minimum wage cannot be lower than the subsistence minimum, which is valid for the working population.

However, again there are exceptions when the employee receives a salary lower than the limit set by the government.

In fact, we described them above, so we’ll just list them briefly:

  • The employment contract specifies the amount of remuneration without taking into account mandatory deductions (taxes, trade union dues, insurance, etc.), and a smaller amount is issued;
  • if a person works part-time;
  • when working part-time (part-time or flexible schedule);
  • if during the month the employee took leave without pay or went on sick leave.

In all other cases, this is already a violation of the law..

Therefore, a citizen has the right to contact the state labor inspectorate with a complaint against the employer. This will be followed by a trial. If the employer’s guilt is confirmed, he will have to pay a fine and compensate the employee for material damage.

  • Fine for the organization can range from 30,000 to 50,000 rubles, and if detected again - from 50,000 to 70,000 rubles.
  • Responsibility for the director or chief accountant may be like this: for a primary violation, they can issue a warning or a fine of 1,000 to 5,000 rubles, for a repeated violation, a fine of 10,000 to 20,000 rubles. Moreover, they can be disqualified for a period of one to three years (Article 5.27 of the Code of Administrative Offenses of the Russian Federation).

  • The minimum wage at the beginning of 2018 was 9,489 rubles, and was later increased to 11,163 rubles (Federal Law No. 41-FZ dated March 7, 2018);
  • The minimum wage in 2019 was 11,280 rubles (Federal Law No. 481-FZ dated December 25, 2018).

Application of the minimum wage

The minimum wage applies to:

  • Regulation of wages. In accordance with the Labor Code of the Russian Federation, the salary of an employee of any organization for a fully worked month cannot be less than the minimum wage.
  • Determination of the minimum amount of benefits for temporary disability, pregnancy and childbirth.
  • government of a constituent entity of the Russian Federation;
  • union associations;
  • associations of employers.

Once the agreement is concluded, all employers are invited to join it: the proposal to join the agreement is officially published in the media. Regional minimum wages are required to be applied by commercial organizations and entrepreneurs of a constituent entity of the Russian Federation, separate divisions located in the constituent entity, government agencies financed from the budgets of constituent entities of the Russian Federation, and municipal institutions. Federal government, budgetary and autonomous institutions are not required to apply the regional minimum wage.

In addition to the regional minimum wage, bonuses and coefficients established in the region are applied. For example, in the Altai Territory, the agreement for 2019-2021 established a minimum wage of 13,000 rubles. At the same time, the regional coefficient of 15% applies in the region. This means that employers in the Altai Territory do not have the right to set wages below 14,950 rubles (13,000 × 1.15).

New minimum wage from January 1, 2019

From January 1, 2019, the minimum wage in the Russian Federation has changed. The new minimum wage increased to 11,280 rubles. This fact will affect the amount of the minimum benefit for a child under 1.5 years of age.
